Civil Money Penalties for Prohibited Referrals to Entities Providing Clinical Laboratory Services and for Prohibited Arrangements and Schemes

This proposed rule would implement sections 1877(g)(3) and 1877(g)(4) of the Social Security Act Section 1877(g)(3) authorizes the imposition of Civil money penalties and an exclusion against any person who presents, or causes to be represented, a bill or claim for a service unlawfully referred under section 1877(a)(1)(A), or has not refunded amounts inappropriately collected for a prohibited referral.
