Private Contracting/Opting out of Medicare
42CFR405.435 was amended on November 21, 2005, in order to clarify that the consequences specified in 405.435(b) for the failure on the part of a physician or practitioner to maintain opt-out will apply regardless of whether or when a carrier notifies a physician or practitioner of the failure to maintain opt out.
