SUBJECT:  Extended Time Limitations for Use of SSBG Supplemental Funds Awarded in Fiscal Year (FY) 2009

PURPOSE:
To provide States guidance regarding the time limitations on the use of FY 2008 SSBG Supplemental Funds Awarded in FY 2009.

Background:

On November 24, 2010, the President signed Public Law 111-285, which extends the deadline for SSBG expenditures of Supplemental funds appropriated following disasters occurring in 2008.  P.L. 111-285 states: “Section 1. Notwithstanding any other provision of law, amounts made available to the Department of Health and Human Services, Administration for Children and Families, under the heading ‘Social Services Block Grant’ under chapter 7 of division B of Public Law 110-329, shall remain available for expenditure through September 30, 2011.”  This instruction provides States with guidance on the expenditure limitations of the SSBG Supplemental funds extension.

Timeline for Obligating, Expending, and Liquidating Funds
By September 30, 2011 States must obligate the extended SSBG Supplemental funds made available by the disaster assistance law enacted on September 30, 2008.  Services rendered using SSBG Supplemental funds must be completed by September 30, 2011.  A State has 90 days – the time at which final reports are due to the U.S. Department of Health and Human Services – to pay for expenditures incurred through September 30, 2011.  As such, a State may pay for the services completed through September 30, 2011 up to December 30, 2011 when the final report is due to the HHS Office of Grants Management.  Additional guidance on allowable activities to assist States in obligating and expending Supplemental funds can be viewed on the OCS website.


Fiscal Requirements for Liquidation of Funds and Final Reports
Unobligated or unexpended SSBG Supplemental funds must be reported on the Federal Financial Status Report form, SF-269.  In addition to the SF-269, States must return the remaining balance of these funds to the U.S. Department of Health and Human Services, Division of Payment Management (DPM). According to 45 CFR  Part 92.50(d)(2), “The grantee must immediately return to the Federal agency any balance of unobligated (unencumbered) cash advanced that is not authorized to be retained for use on other grants.”  Questions regarding the SF-269 and fiscal reporting on SSBG Supplemental funds should be directed to:
