Departmental Appeals Board (DAB)

Examine your paperwork.  Is it a notice of decision, redetermination letter, debt collection notice, inspection complaint, or official decision document from one of the following federal offices:

• ACF’s Office of Refugee Resettlement (ORR)
• Centers for Medicare & Medicaid Services (CMS) - Medicare administrative contractors, nursing homes, providers, or suppliers
• FDA’s Center for Tobacco Products (CTP) - administrative complaint (FDA-YYYY-A-XXXXX)
• Department of Health and Human Services (HHS) or one of its agencies - civil rights (OCR), unpaid debt, inspector general (IG) proceedings, the NIH, the PHS, research integrity, etc.
• Office of Medicare Hearings and Appeals (OMHA) - ALJ decision on a Medicare appeal (X‑XXXXXXXXXX)
• Social Security Administration (SSA) – civil money penalty, debt, inspector general, etc.

If you, or the person/business you represent, received one of the above federal documents and you want to file an appeal, you can file an appeal by registering for access to the appropriate online filing system:

• To appeal an OMHA ALJ’s decision to our Medicare Appeals Council, visit https://dab.efile.hhs.gov/mod (instructions are available here).
• To appeal all other actions, including administrative complaints, prior DAB ALJ decisions, or other types of cases before the DAB’s Appellate and Civil Remedies Divisions, visit https://dab.efile.hhs.gov/
